Terms of Service

The following Terms of Service (“TOS”) govern the agreement between MAK Business Group (“Company”) and the individual or business entity listed on the service request or order form (“Client”). These terms, together with our accompanying Terms of Use Policy (“TOU”), collectively form the binding “Agreement” between both parties named above.

1. Service Rates

The Client acknowledges that they have been fully informed of the initial fees and service rates provided by the Company, and that they have received a detailed description of the services to be performed. The Client further agrees that the Company reserves the right to modify these rates and charges as needed. Any promotional pricing or special offers are subject to the Company’s ability to meet its internal cost objectives, including third-party supplier rates. When possible, the Company will give at least 15 days’ notice prior to implementing any changes in service rates.

2. Payments and Fees

The Client understands that the Company is not obligated to deliver any services under this Agreement until all required fees have been paid in full and the validity of the payment has been successfully verified. Ongoing payments will be due on the first day of the month following the end of the initial billing term and will continue monthly thereafter. Accounts that become overdue may incur a late fee of 10%, and services may be suspended or terminated at the Company’s discretion due to non-payment. All services are offered strictly on a prepaid basis.

3. Refund Policy

All services provided by the Company are non-refundable. This includes, but is not limited to, consultation charges, setup fees, monthly service fees, and any professional service fees, regardless of service usage. Additionally, if the Client’s account is terminated due to a breach of this Agreement or violation of the Company’s Acceptable Use Policy, all payments made will be forfeited and are not eligible for refund. The Client also agrees not to initiate chargebacks on any credit card payments for services already delivered.

4. Service Cancellation

To cancel any service, the Client must submit a request through our billing and customer management system by contacting the Billing Department. All cancellation requests must be received at least five (5) days before the service's renewal date. If notice is not provided within this timeframe, the next full billing cycle will be charged before cancellation takes effect. As all services are provided on a prepaid basis, no partial or prorated refunds will be issued. Additionally, all outstanding balances must be paid in full before a cancellation request can be processed.

5. Billing Errors

The Client acknowledges that the Company strives to issue all invoices accurately. In the event the Client identifies a potential billing error, they agree to notify the Company’s Billing Department within 15 days of the invoice date. If no notification is received within this period, the invoice will be considered accurate and final, and no adjustments or corrections will be applied thereafter.

6. Credit Card Payments

Where applicable, the Client authorizes the Company to automatically charge any credit or debit card(s) provided during the initial order or through later account updates for payment on each invoice due date. Invoices will be sent to the Client in advance of any charges at the start of each billing cycle. If a credit card transaction is declined, the Company will notify the Client and continue attempting to process payment until the outstanding balance is settled. If a full charge cannot be processed in a single transaction, the Client agrees that the Company may divide the total due into multiple transactions across the available card(s) on file until the full amount is collected.

7. Indemnification

The Company shall not be held liable for any damages arising from service interruptions, beyond the value of the fees paid by the Client for services during the affected period. Furthermore, even in instances involving Company negligence, liability will not exceed the amount paid by the Client for services during that same period. The Client acknowledges and accepts that the use of the Company’s services and infrastructure is done entirely at their own risk.

8. Privacy Policy

The Company will never sell, rent, share, or otherwise distribute any customer-provided information to third parties, except when legally required or in response to a valid law enforcement request. The Company reserves the right to collect and use customer information—such as email addresses and website cookies—for internal purposes, including analytics, service improvement, and marketing communications.

9. Violation of Terms

If the Client breaches any part of this Agreement, the Company will make a reasonable effort to contact the Client via email or phone prior to taking further action, when feasible. However, the Company reserves the right to take immediate measures—including suspension or termination of services—without prior notice, if necessary to protect its interests or maintain operational integrity.
